Terms of Service

1. Who we are

Toshi CRM is a software service provided by Toshi Consulting Services ("we", "us"). By creating an account or using the service you ("you", "the company") agree to these terms.

2. Your account

You are responsible for your account, your users, and keeping sign-in details safe.

You must give accurate details and keep them up to date. You must be authorised to act for your company.

You are responsible for everything your users do, and for the lawfulness of the data you put into the service.

3. Plans, trial and payment

We offer plans billed per user per month (or per year). Current prices are on the pricing page and in your account.

A free trial, if offered, converts to a paid plan when it ends. You authorise us (through AutoPay/mandate) to charge the plan fee each period until you cancel.

Fees are exclusive of GST, which is added as required by law. Paid fees are non-refundable except as stated in the Refund Policy.

4. Acceptable use

You must follow the Acceptable Use Policy. In short: no illegal use, no spam or unlawful messaging, no attempts to break or overload the service.

5. Your data

You own the data you put into the service. You grant us a limited licence to host and process it only to provide the service.

We act as a data processor for the personal data you handle; see the Privacy Policy and Data Processing Addendum.

You are the data fiduciary for your customers' personal data and are responsible for having a lawful basis (such as consent) to process it.

6. Messaging and third parties

Features that send WhatsApp, email, SMS or calls, or that connect to platforms like IndiaMART or Meta, are subject to those platforms' own rules and your agreements with them.

You are responsible for obtaining consent before contacting anyone, and for honouring opt-outs.

7. Availability

We work to keep the service available but do not guarantee it will be uninterrupted or error-free. We may change or improve features over time.

8. Suspension and termination

We may suspend or close an account for non-payment, a breach of these terms, or unlawful use.

You may cancel at any time; your plan runs until the end of the paid period. After closure we keep your data for a short grace window and then delete it (see Privacy).

9. Liability

To the extent the law allows, our total liability is limited to the fees you paid in the 3 months before the claim. We are not liable for indirect or consequential loss.

10. Changes and law

We may update these terms; we will show the new version and its date. Continued use means you accept the update.

These terms are governed by the laws of India, with courts at Gurugram, Haryana having jurisdiction.
